TOWN OF WILTON
SELECTMEN’S MINUTES

Date:  April 27, 2009
Time:  6:30 PM
Place:  Town Office
Present: Chairman, Daniel Donovan III, Selectmen Richard Rockwood, William Condra, and Recording Secretary Pam Atwood
 
The meeting was called to order at 6:30 PM.

Treasurer Mark Whitehill attended the meeting to give the Board an overview of the status of the Town accounts.  He informed the Board that considering the present economy, the Town is in pretty good shape financially.  The Highway Department is a bit over budget because of the extreme need for salt this year.  Mark is going to contact other banks to check on their interest rates.  He handed out a Projected Revenues and Expenses worksheet.

Selectman Rockwood reported that Brox Corporation would accept payment after July 1, so the Highway Department can begin some resurfacing projects.

The Debris Removal Bid was discussed.  Chairman Donovan reported that seven bid packages had been taken, but only 1 had been returned.  That one proposal was from Jungle Jims of Epsom, NH.  The proposal was for all seven segments of roads at a price of $42,000.

Motion:  Selectman Condra made a motion to accept the contract from Jungle Jims contingent upon getting an answer regarding the timeframe for completion of the work. Chairman Donovan seconded the motion with all in favor.

The next issue discussed was the signage for Bennington Battle Trail.  It was suggested that possibly the Conservation Commission or Heritage Commission might want to clean up the trail and make a sign for the trail.

Correspondence was received from Wilton Main Street Association regarding road closure.

Motion:  Selectman Rockwood made a motion to accept the road closure for the Main Street “Celebrate Wilton” event as long as they don’t put stakes in the road or do any damage.  Selectman Condra seconded the motion with a vote all in favor.

Devin McEntee and Ambulance Director Caryl McEntee attended the meeting for the appeal of Mr. McEntee’s suspension.

Motion:  Chairman Donovan moved to go into Non-Public session per RSA 91-A3, II (c). A roll call vote with all in favor was made.

Chairman Donovan called the regular meeting back to order at 7:16 PM.

Chairman Donovan spoke of the burden of proof in the Devin McEntee case.  He explained that the burden of proof fell on the Town of Wilton to determine whether the discipline should be upheld and that Director McEntee was an agent of the Town and that Director McEntee could proceed first.

Director McEntee referred to a letter she had given to the Selectmen outlining the issues she was having with Devin.  Director McEntee detailed four major areas of concern including: Two violations of the HIPPA privacy rules, lack of respect to members of the Ambulance Service, problems following directions, and Devin’s dangerous and reckless driving habits.

There was discussion between the Board and Director McEntee as to whether Devin had been fired or suspended.  It was clarified that his status was “suspended”.

After a few smaller issues were discussed Chairman Donovan instructed Devin that he could present his side.

Devin noted that he felt “guilty by association” of the alleged HIPPA violations.  He also mentioned that he had never received HIPPA training except what is offered in the EMT class.  He also said he never had any Ambulance driver training.

Devin discussed his desire to help people and work as an EMT.

Several people in attendance spoke on Devin’s behalf, complementing his work, energy and professionalism, but also mentioned that there had been issues with Devin’s driving.

When both sides were finished with the discussions, Chairman Donovan reminded Devin that all documents at this hearing became part of the public record.  The Board will review and discuss this hearing and make a decision as soon as possible.  It was suggested that Director McEntee and Devin should try to resolve their differences.

The next item of discussion was additional comments regarding the signage at Bennington Battle Trail.  The Board will invite the residents of Bennington Battle Trail and the chairmen of the Conservation and Heritage Commissions to attend a Selectmen’s  meeting to discuss the issue.

Selectman Condra discussed the York River lots on Carriage Hill Road, noting that he had talked to the tax assessor about the lots, specifically whether they were in or out of Current Use.  Selectmen Rockwood noted that a decision had been made last week on this issue.
