Maurice Guay attended the meeting to discuss dumpster hauling at the Recycling Center and to see if anything would change before winter. Last month’s tonnage seemed to be low so Maurice will run it another month. Maurice went to Amherst to see how they run their facility. Maurice got a price to put a roof over the extra dumpster. The Board decided that things are running smoothly now so a roof is not needed at this time. The Board asked Maurice about the 2000-gallon tank. Maurice will let the Board know when it is empty.
Keith Carmen attended the meeting at the Selectmen’s request. The Board wanted to talk to Mr. Carmen about a building permit he had issued for construction of a new modular home. The Conservation Commission has expressed concern that there is a Wetlands issue at the location on Map C Lot 43 on Davisville Road. Discussion ensued as to how Keith should check for Wetlands in the future.
Chairman Donovan had the Town attorney look at the area in question. Attorney Little found violations and concluded that the building permit should not have been issued. He suggested that the Town should issue a Cease and Desist order. All three Selectmen agreed.
The next issue discussed with Mr. Carmen involved the new Bakery located in the yellow block. Mr. Carmen issued a plumbing and an electrical permit to the business owner. He did not issue a building permit because nothing was being built, however, Keith did not realize that the Bakery owner should have gone to the Planning Board for a “Change of Use” application. Following some discussion Chairman Donovan explained to Keith that if an application is for commercial use or a residence with 4 or more units they must go before the Planning Board.
Mr. Carmen asked the Board for their opinion regarding a couple questions that he got from his customers. One question referred to whether the Building Inspector should be inspecting wood stoves. In the end, the Board agreed that any “vented fuel burning appliance” should require a permit. The permit would then trigger an inspection by the Building Inspector.
There was more discussion on the issuance of building permits. Selectman Rockwood suggested that Keith visit a site with wetland issues before issuing a permit. Selectman Condra suggested that Mr. Carmen create a list of questions to go over with each applicant. Chairman Donovan suggested that the building permit might need to be redesigned providing an area designating if the property is in the Wetland, Floodplain, or Aquifer Protection area.
The Cease and Desist order was discussed further. Chairman Donovan said that the Police Department would hand deliver the order on Tuesday, October 7, 2009.
The next item on the agenda was a written request from the Census Bureau to register for the New Construction Program. This program supplies the Census Bureau with addresses for all new houses built in Wilton during the last year. Selectman Condra volunteered to be the liaison for this program.
Pam relayed a message to the Selectmen from Attorney Little regarding Colby Street Realty. There have been no changes in this situation recently.
The Selectmen have been asked by Chief Hautanen to attend a meeting on October 20th regarding the Milford/Merrimack court merger. The Board is against this merger and will make every attempt to attend this meeting.
Payroll for week ending October 3, 2009 was approved.
Bills for week ending October 3, 2009 were approved.
The information material and correspondence was reviewed.
The meeting was adjourned on a motion at 7:50 PM with all in favor.
