Wilton Conservation Commission – Minutes of 20 March 2006

 

 

Present:  Spencer, Alan, Les, Laurence and Lynne.

 

 

  • McKay Dredge & Fill Request:  We received a letter from DES regarding this request.  We need to respond to same.  Lynne handed out a package to everyone, consisting of the Dredge & Fill Request and the DES letter dated 23 February 2006.  We discussed our concerns:

-         Our main concern is that this area is within the Watershed District. 

-         Les restated his concern about the Soil type # 197 and the freshwater marsh; must be careful of that, no polluting. 

-         Spencer noted no feeding of wildlife, which would cause further pollution to the brook; no fertilizer; and must stay within the perimeter of the “existing” pond. 

-         We noted there are no dimensions or scale on the design plan regarding the area of the pond and side slopes, and no mention of any replanting/reseeding of spread soil.

-         Need to know the size of the existing pond – it does not seem to be 18,000 square feet as mentioned on the permit request.

-         No further cutting of woody brush and trees in the general wetlands area.

-         Where is the disposal area?  No fill to be placed in any designated wetlands.

-         Have a wetlands scientist delineate the wetlands.

-         Produce a proposed plan.

 

Lynne to write a letter to DES (copy McKay, Selectmen, Town Clerk and Planning Board) outlining our concerns as stated above.

 

 

  • Pike Quarry – Release of Sediment/Impounded Water.  We received a copy of the letter from Planning Board to DES regarding this release of water, with copies of photos.  Matt Fish delivered color copies of the photos, which were very explicit.  This is another example of the ongoing problems with this business.  The situation is beyond the education phase and must be properly corrected and enforced.  We concur with the Planning Board, and are frustrated with the lack of enforcement and/or any penalty to get them to follow the policies.

 

Lynne to write a letter to DES (copy Planning Board, Selectmen, Lyndeborough Conservation Commission, Pike, George May at Souhegan Watershed Association, and Steve Couture at NH Rivers Management and Protection Program).

 

 

·        Town of Tamworth – Discussion of Anderson, et al v. Motorsports Holdings, LLC.  This is an issue in the Town of Tamworth relative to Wetlands Ordinance matters, and has a direct relation to local control.  Motorsports Holdings feels they do not need a wetlands permit from the Town of Tamworth because they have one from NH DES.  The Town of Tamworth does not agree with this position and has written to conservation commissions throughout the State asking them to support an amicus brief to be filed by the New Hampshire Association of Conservation Commissions in the matter of Anderson, et al v. Motorsports Holdings, LLC.  The Town also has the support of the New Hampshire Municipal Association.  We support this argument, especially as it relates to local control.  As more and more development pressure comes into the state, towns need to be able to control what happens and not depend on state agencies.  The Town of Tamworth sent a sample letter for conservation commissions to send to the New Hampshire Association of Conservation Commissions. 

 

Lynne will use that basic letter, edit it somewhat, and send it to the New Hampshire Association of Conservation Commissions.

 

            Lynne will forward copies of all these letters to WCC members.
